The AI and Copyright Conundrum

Emerging approaches in the EU, UK & beyond

Generative AI — and the training and deployment of large language models (LLMs) — calls into question traditional concepts of intellectual property, and more specifically, the application of copyright laws. Around the world, policymakers are trying to balance the interests of rights holders and AI developers in pursuit of thriving AI and creative ecosystems.

To navigate this fast-moving area of policy and regulation, we analysed the current legislative framework on AI and copyright in the EU, UK and key global markets. We took stock of the current state of the debate surrounding AI and copyright, providing a bird's eye view of key issues.

We found a global patchwork of approaches — for a technology being developed and deployed across borders. This analysis sets out our observations based on our expertise and network, alongside our expectations regarding potential future interventions from EU and UK policymakers.
